Indianapolis Family Medical Leave Act Attorneys

With more and more people suffering from the stress and difficulty of trying to balance both work and family life, and especially after personal problems began to arise, the Family Medical Leave Act (FMLA) was passed, providing employees who were qualified under the act with up to 12 weeks of unpaid leave without the fear of job or health benefits loss. Employees are considered to be eligible for these benefits if their employer is a public agency, a private or public school, or employs at least 50 people, and if he or she has worked for that company for a year for at least 1,250 hours and works within 75 miles of the employer.

Those people who are qualified under the FMLA are able to take valuable time off work without worrying about losing their job or benefits if they are in one of the following situations:

  • Needs to take care of a child, spouse, or parent who has a serious medical condition, which is considered to be an illness, injury, or condition, either physical or mental, that requires care in a medical center or ongoing medical care from a health provider.
  • Needs to take care of him or herself due to developing a serious health problem.
  • Needs to care for a newborn child or a child that was recently placed under the employee’s care through adoption.

If an employee believes that they will need to use FMLA leave, they must provide their employer with at least 30 days notice if the need to use the FMLA leave is foreseeable. If the need to use the FMLA leave is not foreseeable, the employee must give the notice to their employer as soon as is practical.
